Freedom of Expression

While describing an assessment I often use to a lawyer-client, I mentioned that it provides feedback about one’s natural tendencies and those tendencies as adapted to work, explaining that almost everyone wears a “mask” of some sort at work.

“You got that right,” my client chuckled wryly.

We went on to discuss the discomfort this client feels in the workplace.  She chooses not to be herself in the office, to rein in the zany and hilarious side of herself in an effort to show up as the cool, calm professional whose judgment is above reproach.  And, frankly, it’s hard to blame her or any of the others who make a similar decision.  Especially in a competitive world in which reputation may be built on first impressions and damaged in a moment, playing it safe may be an appealing choice.

That said, when there’s too much of a gap between one’s “real” self and one’s “work” self, going to work may become unbearably stressful.  A great deal of energy can be consumed by molding oneself to expectations, and everyone I’ve known to be in such a situation gets worn down by maintaining a false persona.  Even more troublesome, authenticity is generally regarded as a key leadership attribute.  People often sense inauthenticity, and when authenticity is lacking, it’s tough to build or maintain relationships.

I’ve always enjoyed the quote, “Be who you are and say what you feel, because those who mind don’t matter and those who matter don’t mind.”  (Attributed, variously, to Walt Disney, Dr. Seuss, and Bernard Baruch.)  Of course, those who employ or retain you do matter.  So, what if you feel required to present yourself as someone you aren’t?  The question is much too big for a single blog post, but I’ll throw out a few ideas.  If it generates sufficient interest, I’ll elaborate on another day.

1.  Change positions.  Sometimes it’s a “fit” issue.  A firm’s “culture” will define what is and isn’t acceptable, and a baseline fit between lawyer and firm is important.  While it’s unlikely that you’ll find a firm that allows you to be exactly who you are at home on a weekend morning among family or close friends, it is possible to find a firm where you can be more or less the same person.  If the “fit” is wrong, you’ll likely have the metaphorical sense of wearing a suit that’s too tight: constriction at work followed by the renewed ability to breathe when you’re elsewhere.  If you’re happy with your professional self, then the suit has to go.  Just be sure to note the areas of constriction so you’ll know what atmosphere would be a better fit.

2.  Practice allowing your personality to show.  Sometimes the issue is one of comfort: personality might be welcome, but you need to develop a certain comfort level to believe that’s true.  Try cracking a few jokes, mentioning your interest in feng shui, or hanging that unusual painting in your office.  And measure the reaction you get.  Assuming a reasonably good fit, you’ll probably begin to relax a bit (when the situation is appropriate for relaxing) and allow your slightly quirky self to show.  Treading slowly is probably a good idea: no one appreciates the colleague who lets the freak flag fly a little too high.  But personality is part of what will draw other lawyers and clients to you.  No one wants to work with an automaton.

3.  Express yourself in covert ways.  One of my good friends (not a lawyer) served as a consultant for several years for one of the big companies that functioned remarkably like a law firm.  She bought a toe ring that reminded her of her “outside” life and the trip to the Bahamas where she bought the ring.  I’ve known lawyers who relished having a navel piercing, living in an unusual part of town, or playing in a rock band on the weekends — none completely secret, really, just private enough to share with a select few.

4.  Act in integrity with your values.  On occasion, I’ve known lawyers who felt they were required to conform in distasteful ways.  Choosing to laugh at jokes that conflict with deeply held beliefs, for instance, puts a higher value on conformity than on the deeply held belief.  Integrity requires finding some way to reconcile belief and action, whether it’s ignoring or challenging the distasteful view.  Sometimes it’s an opportunity to educate, and sometimes it’s a sign that the firm/lawyer fit is wrong.

Freedom to choose

It’s been a busy weekend at the Fleming-Brown household.  One of my dogs, Jake, is the most cowardly animal I’ve ever met when it comes to thunderstorms — and the most wily.  Both dogs sleep downstairs in crates, mostly because my cat would become a canape if they were allowed free reign at night.  We’ve been having thunderstorms in Atlanta lately, and Jake has become an escape artist extraordinaire.  Despite latches at the top and bottom of the door and reinforcements added on a daily basis, Jake has learned to escape his crate.  (Had I been his first family, with naming privileges, I would have named him Houdini, since the Crate Escape is just the latest in a long line of breaks.)  I don’t know why he wants to escape, and my guess is that he doesn’t either.  He hears a clap of thunder, and his reaction is, I gotta get out of here!

I’d decided to write on the theme of freedom this week, in honor of July 4, and today’s post is particularly motivated by Jake.

Stephen Covey, perhaps best known as the author of The Seven Habits of Highly Effective People, said this about freedom: “Between stimulus and response is our greatest power – the freedom to choose.”

How often do you react, and how often do you respond?

Reaction imples knee-jerk action, with little or no thought — perhaps when you discover that something has gone wrong with a case, that there’s a deadline looming and you’ll have to work all night, or that a client was irritated by a sloppy error, and you react by shooting the messenger?  At the risk of comparing a lawyer with my dog, Jake lives in reaction mode.  Thunder = run for him, period.

Responding suggests allowing enough space to consider the consequences and implications of action and then choosing: given the same bad news, you might respond by swinging into problem-solving mode rather than anger.

Just about everyone is more likely to react when stressed, tired, or otherwise not operating at peak levels.  Fortunately, there’s a single action that you can take to build in a pause and an opportunity to respond, almost regardless of the provocation.  (I’m excluding physical provocation here.)

Take a deep breath.

Just breathing will create a break between action and reaction/response.  During that break, you can choose whether fight/flight/argument/acquiesence and you can consider what response will be likely to move you toward your goal.  You might shoot the messenger anyway, of course: we all make choices we regret even after thinking them through.  But you will have created the opportunity to make a conscious decision, increasing the chances of a response you won’t regret. ◊

Three Obstacles to Rainmaking Success

I’ve been doing a lot of speaking and coaching lately on business development, and someone asked a great question: what are the top obstacles to rainmaking success?

I’ve identified three universal challenges.  Do any of these sound uncomfortably familiar to you?

1.  “I don’t know what to do.”  There’s so much information out there about how to bring in new cases and clients and, even more importantly, how to ensure that your current clients are satisfied — no, delighted — with the service you provide.  Sometimes, having lots of good information is overwhelming.  When I work with someone on rainmaking, one of the first things we focus on (after clearly identifying the goal at hand) is to simplify tasks, according to a targeted plan.  Don’t flail around and try “the latest thing.”  Figure out what works well for you and do it consistently.

2.  Mindset challenges.  The challenges that we create up for ourselves (and please note that I am including myself here!) vary dramatically.  I’ve heard all of the following:

  • Rainmaking is easier for them (men, women, lawyers in big firms, lawyers in small firms, litigators, transactional lawyers, and on and on and on).
  • Everything I do has to be perfect, and I’m busy getting ready to get out there.  (This crops up a lot with lawyers who see speaking, writing, and holding leadership positions in an organization as a good route for business development.)
  • I have to do it all myself, so I’m going to clear the decks and then get started.
  • I’m too young.
  • I’m too old.
  • I tried [insert an activity here] and it didn’t work, so why should I bother?
  • My technical skills are so good, I don’t need to market.

There may be at least a grain of truth to each of these rationalizations (and the infinite variations that exist), but buying into these statements is a huge red flag.  These “reasons” justify a lack of success and perhaps even a lack of effort.  Neither leads to great results.

3.  “I don’t have enough time to get my work done and live, and now I should add on business development activities?  You’ve got to be kidding me.”  This obstacle is the most valid and therefore the most insidious.  It also plays into the mindset obstacles, because very often a lawyer who holds a negative belief about client development will sink more and more time into fruitless rainmaking activity.  Imagine, for instance, a lawyer who polishes an article to the point of “perfection,” only to find that it’s no longer newsworthy.  Fortunately, you can implement three steps to create time for business development: prioritization, systemization, and delegation.

When personal life impacts professional life

One of the ways that I describe the work I do is “professional and personal coaching for lawyers.” Although I occasionally do what amounts to life coaching for someone who happens to be a lawyer, my passion lies in helping lawyers develop their professional lives, which often relates in some way to their personal lives. We are, after all, people first and lawyers second.
Sometimes, the relationship between the professional and personal sides of life becomes blurred. That may be a work/life balance issue that calls for reflection on the degree, if any, to which the lawyer wants to separate the two.

But sometimes, a lawyer will experience a personal problem that he can’t keep entirely separate from his professional life. Serious illness is one example, though the challenge there tends to come when the actual crisis is over, when recovery begins. My take on that situation is rather clear: do whatever is necessary to ensure your reclaimed health, no matter what professional consequences may follow, but conduct your affairs so that your clients don’t suffer. Then there are the personal circumstances that don’t have the potential for personal life-or-death consequences. Examples are a family member’s prolonged illness or death, or facing the prospect or reality of divorce. Although most of us are practiced at putting on the “game face” and getting on with work, events of this magnitude may make it difficult or impossible to manage that. Each person is, of course, different, and no solution will fit everyone. Here, however, are some ideas of coping mechanisms.

Support. Get the support you need, whether that’s counseling, a support group, a coach, or some blend of the three. Asking for help may not come naturally, but it can help you avoid mental or emotional tunnel vision and help you identify your best options.

Consider whether to share your news. Depending on the situation, you may need to let a colleague or supervisor at your firm know what’s going on. There’s no need to share details, but especially if you suspect that there will be an actual conflict between your professional responsibilities and your personal ones, it’s often best to let someone else know.

Practice centering exercises. Whether it’s meditation, yoga, or just deep breathing, physical activities can help you center yourself so you are better prepared to deal with work while you’re working and less likely to be pulled away mentally or emotionally by whatever is causing you distress. This can be as simple as sitting in silence for 3-4 minutes and paying attention to your breath, gently releasing any thoughts that may come up. The beauty of a practice this simple, of course, is that you can revisit it at any moment, without even letting others know you’re doing it.

Excellent self-care. Get enough sleep. Eat real, healthy food. Don’t drink too much alcohol. Keep your body well-hydrated. When you’re under severe stress, it’s easy to let this go, but the extra effort will serve you well.

Be realistic. You may need to cut back on your hours, take a “vacation,” or even take a leave of absence. Or you may not. Just don’t try to be a hero. A realistic appraisal of your energy will keep you from taking on too much, causing yourself to crash and burn.

Reflect. Journal writing can be a terrific tool for working through difficult issues.

Manage your energy. Take advantage of the days when you have sufficient energy to work hard. Although you can take steps to keep your energy as high as possible (the other steps suggested here, for instance), it’s a reasonably safe bet that your energy will lag at some point, and you’ll be able to work with that rhythm if you maximize your output when you can.

Remember that this, too, will pass. It’s a trite saying that may not offer much comfort in the moments of deepest pain, but the difficult times will not last forever.

Leaders are better rainmakers.
  Bold statement, isn’t it?  But think about it.  Would you easily place your trust in someone who manages a team of worker bees who don’t make much individual contribution – knowing that if the manager goes down, the team will at best miss a few beats?   Or would you select someone who is skilled in assembling a strong team and evoking high performance from its members?

 

Clients generally hire lawyers, not firms, but clients count on the lawyers to assemble and run the teams necessary to get the business accomplished.  A leader is more likely to walk into a meeting with a prospective client and present not only his or her own professional experience, but also that of the team, complete with discussion of how the team as a whole would function to meet the client’s needs.  There’s a difference between a team leader who counts on the skill and expertise of team members and a legal hotshot who regards the team as merely a supporting cast.  Clients and potential clients (not to mention the team) will sense that difference.

 

A leader is more likely to show up for a meeting with a client or prospective  client ready to ask questions.   Which is more impressive, someone who talks nonstop about the cases she’s won and the professional accolades she’s received, or someone who asks questions first to determine what’s needed and then offers how her skill and experience would serve to meet those needs?  Which behavior is more characteristic of a leader?

 

Leaders have the emotional intelligence to establish strong relationships, even when something goes wrong.  Unfortunately, despite our best efforts, legal matters don’t always go the way they “should.”  Juries are notoriously unpredictable, case law changes, and unforeseeable events happen that derail strategies, no matter how carefully planned or executed.  Leaders tend to have the integrity to take responsibility when appropriate, and they have the discernment to focus on how to make things as right as possible under the circumstances.  By handling problems in this way, leaders tend to become trusted advisors rather than hired guns.

 

What part of your leadership development path is calling for focus so you can also improve your client service and business development skills?  Perhaps it’s your presence, since the way you hold yourself and the way you communicate both verbally and non-verbally can have a dramatic impact on how you’re perceived.  Perhaps it’s your self-management in the areas of time or energy.  Or perhaps you could be a more effective team leader, whether your team is the whole firm, a practice area team, a client matter team, or a project team.  Make the time to improve your leadership skills, and you’ll see client benefits as well.

Book Review: The 21 Irrefutable Laws of Leadership

The subtitle of Maxwell’s book is “Follow Them, and People Will Follow You.”   Each time I read that, I hear a rejoinder in my head: “Don’t follow them, and people won’t follow you.” Revised and updated in 2007 for the 10th anniversary of The 21 Irrefutable Laws, this book is rightly regarded as a foundational piece of the leadership literature.

As the title indicates, Maxwell presents 21 laws of leadership, all of which are free-standing and yet buttressed by one another. You can learn a lot simply by reviewing the 21 laws with Maxwell’s brief explanation of each:

1.  The Law of the Lid: Leadership Ability Determines a Person’s Level of Effectiveness
2.  The Law of Influence: The True Measure of Leadership Is Influence — Nothing More, Nothing Less

My favorite law, the umbrella under which all of the other laws fall, is the Law of Process. Leadership can’t be developed in a day or a week. Instead, it grows and becomes refined through a lifetime of self-management, skills acquisition, and relationships:

If you continually invest in your leadership development, letting your ‘assets’ compound, the inevitable result is growth over time. What can you see when you look at a person’s daily agenda? Priorities, passion, abilities, relationships, attitude, personal disciplines, vision, and influence. See what a person is doing every day, day after day, and you’ll know who that person is and what he or she is becoming.

Often, when I speak to newer lawyers about leadership development, someone in the group will ask why a new graduate or a lawyer in the first few years of practice should be concerned with leadership development, since they’re at the bottom of the totem pole. My answer is three-fold.

First, it’s critical to lead oneself and develop a strong foundation in self-management. Second, usually even “bottom of the totem pole” lawyers soon have an opportunity to lead something, whether it’s a document review team or a subcommittee. And third, as Maxwell writes, “champions don’t become champions in the ring — they are merely recognized there.” If a lawyer waits until a leadership position is on the horizon to begin developing good leadership skills, the position may never present itself, or if it does, the lawyer will lack the necessary skills to thrive in that position. (Incidentally, point 3 is well illustrated in Maxwell’s first law, the Law of the Lid.)

What’s in it for lawyers? Although each of The 21 Irrefutable Laws is important for leadership development, perhaps none speaks to the profession in quite the same was as the Law of Explosive Growth. That law holds that leaders who develop leaders create an organization that can achieve explosive growth, since “for every leader they develop, they also receive the value of all of that leader’s followers.” Imagine the potential for enormous and sustainable growth in a law firm in which leaders are developed.

Read one chapter a week and apply what you learn. Without question, you will grow as a leader, and you’ll see the difference in your day-to-day life and practice, with clients, and in whatever leadership roles you may hold.

The root of the rainmaking struggle?

How often have you heard (or perhaps even said) that only a select few lawyers are good rainmakers?  I hear it all the time, and though I agree that not everyone can be a world-class rainmaker, just about every lawyer willing to put in the effort can learn to bring in business.  A variety of pressures make business development challenging and at least one personality tendency: introversion.

I’ve worked with many clients who consider themselves to be introverts and who, therefore, hate doing the relationship-building that is the foundation of business development.  I love working with those clients, because I’m an introvert too, and I’ve learned plenty of strategies to make networking painless.

A new book, 200 Best Jobs for Introverts, places law as the sixth best job for introverts — right after computer software engineering, computer systems analyzing, network systems and data communications analyzing, and accounting/auditing.  Law also garners the spot as the second-highest paying job for an introvert, right behind astronomy, with a reported average annual earning of about $98,000.

Think business development doesn’t matter? Think again.

I occasionally talk with associates, in the first few years of practice ranging through senior associate levels, who tell me that they don’t need to pay attention to business development.  The reasons vary.  Some lawyers feel they’re “too new,” some don’t plan to make partner and think business development is therefore irrelevant for them, and some say they’re just not good at business development — so why bother?

My answer is the same in every case.  You should only be concerned with business development and networking (which is the foundation of business development) if you want to have a career.  Any career.

Harsh?  Maybe.  True?  Absolutely.  Let’s take a quick look at each objection.

I’m too new!  The best time to begin thinking about business development is a few years ago, and the second best time is now.  That’s true even if you graduated from law school this week.

College and law school classmates may not be in a position to deliver high-dollar legal work now, but some (perhaps many) of them will at some point.  They’ll want to send their work to someone they know, like, and trust.  Who better than a long-time friend who’s established a strong professional reputation?  If you aren’t that person, one of the (other) classmates with whom you’ve lost touch very well may be.  Likewise, the low-level employee with whom you discuss interrogatory responses will go up the chain of command as you do.  Wouldn’t it be nice to have a strong relationship with her as she moves into positions of power?

Bottom line?  You’re never too new to begin networking and establishing good connections with those who will be future decisionmakers.

I don’t want to be a partner, so business development doesn’t matter for me.  Partnership certainly isn’t for everyone.  But unless you plan not to work (in or out of law) after leaving your firm, you should be networking anyway.  If you want to move in-house, connections with clients and with other lawyers may pave the way.  The same holds true if you choose not to practice law: only a small fraction of positions are filled solely through advertisements.  The rest are filled through, or with the help of, contacts.  And other activities generally undertaken for business development purposes (such as writing articles and speaking) help to establish a reputation and a reach that will be useful when searching for a new job or career.

If you plan to continue practicing law in a firm, portable business is your key.  Lawyers up to their 3rd or 4th year of practice may make a lateral move without portables.  Past that level, however, such a move is difficult (always, and even more so in today’s economic environment) if not impossible.

And, by the way, if you change your mind and do decide to shoot for partnership, you must be able to show you have at least the strong likelihood of generating business, and many firms will require (explicitly or not) that you have brought in work already.

Bottom line: almost regardless of what kind of work you do, business development will play a role.  Get started now.  Delay won’t make it easier.

I’m not good at business development!  Perhaps not.  Perhaps you’ll never be a rainmaker extraordinaire.  But you can learn some skills and you can polish your approach.  You can implement plans to make sure you’re regularly performing the activities likely to lead to new business.  Observation convinces me that, especially with some guidance and assistance from a mentor or coach, someone who is dedicated to business development will succeed.

Again, the level of success may vary (and the ease of realizing success), but one thing is certain: if you don’t try, you will not succeed.  Don’t fall prey to the lazy thought that your inexperience or discomfort with client development (or inadequate skill in it the steps that generate business) means that you can never be a sufficient rainmaker.

Is it what you thought it would be?

My home office in Atlanta is on a two-lane primary road just a few blocks from Emory University’s law school.  Today is graduation, and since about 6:30 AM, I’ve been watching cars full of well-dressed people, taxis, chartered buses, and even limos drive by.  It’s quite the parade!  And in fact, today marks the 15th anniversary of my own law school graduation at Emory.  And so, I’m wondering.

Is your life as a lawyer what you expected? Perhaps not in the details of where you’re working or even what kind of law you’re practicing, but in the larger picture of how you spend your days, whether you enjoy what you’re doing (at least, most of most days), whether you can see yourself continuing on this path for the foreseeable future.  Is your career successful (as you define successful), satisfying, and sustainable?

If not, what’s falling short?  If your practice isn’t sufficiently successful, do you need to work on business development or leadership skills?  What would it take for you to feel satisfied?

PDA Peace

Pavlov’s dog had nothing on most BlackBerry/iPhone/BlackJack/other PDA users.

All too often, we (and I include myself) hear the “beep” or feel the vibration and pounce immediately, even in the middle of a sentence — our own or someone else’s.  And I’ve seen (and though I’d prefer not to admit it, experienced) the discomfort that can occur when someone knows there’s an email waiting but doesn’t pounce.  The ticks, the nervousness.  It’s almost pathological sometimes.

Recently, I decided to drive for a business trip rather than fly, and for safety’s sake, I didn’t want to be tempted to look at my BlackBerry everytime an email came in.  So I set the profile to ring for phone calls only, and to be silent otherwise.  I drove almost 150 miles before I had to stop for gas, and I checked the BlackBerry then.  I had about 40 messages, none of them urgent.  And I had a strange feeling that I subsequently identified as peace.  Peace!  No irritating noises, no demands, no irrelevant press releases.  It was a good change.

That was a month ago, and I’ve continued to keep my BlackBerry on “phone only.”  If I’m expecting something urgent, I ask for a phone call rather than an email, and it’s been truly instructive to discover how much better conversations are when I’m not wondering about the email I just heard arriving.  And the truth is, I have yet to miss anything important as a result of this practice.

Try it.  Just for today.  You can change back tomorrow if you like.  I predict you won’t want to, and I predict you’ll be more present to your work, the people you’re with, even your own relaxation.  And in turn, you’ll be more productive and more creative.

Not a bad return on eliminating an irritant, is it?
