Weekly Rainmaker Activity 8/31/09

A primary benefit of being active online (by having a website with a biographical sketch and having articles relevant to your practice published online, for example) is that potential clients have an opportunity to learn something about you before meeting you.  Whether your name surfaces by referral or by an internet search, it’s a safe bet that almost every potential client will search on your name before contacting you.

Do you know what these potential clients will find?  I recently read an advice column in which the writer was struggling with how to tell her doctor that his son, who shared the doctor’s name (plus a “junior”),  had posted “obscene” photographs on Facebook and that patients were finding those images and associating them with the doctor.  I imagine that the doctor and his son had a rather frank conversation after that revelation, but the questions go a step further: how long had the doctor’s reputation been damaged by his son’s online antics?  And more importantly, how could he recover his professional reputation online?

Your task today: perform an internet search on yourself.  Start with Google, as it’s the most popular search engine, but be sure to check Yahoo!, Ask.com, Excite.com, MSN, and so on.  What do you find?

You may disover that your profile on a social media platform is high on the result list.  If so, one of the quickest ways to ramp up your online presence is to be sure that your profile is complete, accurate, and up-to-date.  If it’s difficult to find yourself online, getting a LinkedIn profile is a quick and easy way to make sure that those who search for you will be able to find something useful.  And if you find results that conflict with your professional persona, consider how you might address them.

Weekly Rainmaker Activity 8/17/09

Studies show that a prospective client must be exposed to you 7-9 times before they’re ready to hire you.  (Those statistics are not specific to law, granted, but I have no reason to believe they’re off the mark for lawyers.)  The reasons are simple: most potential clients don’t have a current legal need, are already represented, or aren’t sufficiently familiar with you to entrust you with their current legal matter.

The solution should be clear: continue the conversations with your potential clients and potential referral sources.  That’s how you will become known, liked, and trusted — and it’s how you’ll get clients.

So, here’s your assignment this week: Look at the stack of business cards you’ve been saving (you have the stack, right?  Tucked “somewhere safe,” in a desk drawer, or near your computer?) and select 3-5 people with whom you should follow up.  Then, get in touch with them.  Offer something of value if possible — an article likely to interest them, for example.  Alternatively, just pick up the phone (or perhaps drop an email) and let your contact know you were thinking of her and want to know how she’s been since you last talked.

Some contacts will be dead-ends.  Others will hold promise for future business.  But you’ll never find out which are which unless you continue the conversation.

Do you sponsor? (And WRA, resurrected)

Do you know how to get the most from your sponsorships?

Getting in front of a group of potential clients can mean different things to different people.  These are some of the considerations I recommend you evaluate if you’re contemplating taking on a sponsorship:

  • Who will be present?  Potential clients or referral sources are good; the general public is less likely to produce measureable business results.
  • What recognition will you receive as a sponsor?  Will your firm name be on the signage, on the event website, on bags or t-shirts?  Will you be mentioned during the event itself?
  • What perks will you receive as a sponsor?  Look for opportunities to mingle with attendees at sponsored luncheons, coffee breaks, or cocktail parties.  You’re more likely to be able to meet selected participants if the sponsored event is not open to all comers.
  • Who will attend from the firm, and what is the strategy for making the most of the opportunity?  As usual, without a plan, your efforts are likely to produce little.  The strategy will depend on your business development goals, the nature of the event, the attendees, and more, but you must be able to identify at least the basic strategy before you commit to sponsorship.

Sponsorships aren’t dead, by any means, but it’s just a waste of money to take on a random sponsorship without a defined objective and a clear plan to reach that objective.

WRA, Resurrected!

Back in January, I launched a new weekly blog feature: the weekly rainmaker activity.  I described it this way:

One of the keys to being a successful rainmaker is making a habit of consistent client development activity.  I recommend that lawyer doing something designed to increase business every single day, whether it’s writing a 2-minute email, hosting an hour-long lunch, or attending an all-day industry meeting. I’m launching a new blog feature this week: the Weekly Rainmaker Activity.  I’ll offer a weekly business development task.  Those who choose to accept that challenge will make the time to engage in the activity of the week at least once.  If you’re so moved, please post a comment (anonymous is fine, of course) to let me and the other readers know what you’ve done this week.  Healthy competition of this sort can benefit everyone.

And then I started writing The Reluctant Rainmaker, thus effectively putting the blog on hiatus.  Ooops.  But now, it’s time to resurrect the WRA, and the first task will be posted Monday.

Renewing lapsed professional relationships

I gave a 1-hour presentation about rainmaking last week in the Chicago office of a large law firm, and following the presentation, a lawyer approached with a question: Is it ever too late to rebuild professional relationships that have languished?

The short answer is that it depends on the relationship. The deeper the relationship, the more likely it can be resurrected.  If, however, you meet once and fail to follow up, or if you follow up only once or twice, the relationship will lack the firm footing necessary to allow it to flourish following a period of silence.  That said, it never hurts to try to rebuild a relationship, particularly if your sole reason for reconnecting is to re-establish communication and not to seek a favor.

So, what can you do to rebuild a connection that has faded? The simplest, and often the most effective, approach is to do precisely what you would do with a friend you haven’t seen in a long time: pick up the phone and say, “I realized it’s been a while since we’ve spoken, and you’ve been on my mind.  Is this a good time to talk for a few minutes? How are things with you?  What’s new?”  If several months have passed since you were in touch with this contact, you may even begin the conversation by re-introducing yourself.  (This is where my recommendation to maintain a database of contacts proves especially helpful: you don’t have to try to remember when and where you met.)  You may experience a few awkward moments as your contact gets back into the connection, but most people will pick up relatively quickly.

If, like many lawyers, you’d rather do nine hours of painstaking document review without a coffee break than pick up with phone, you do have other options. For example, you might consider the following:

  • Send an email to reconnect. You might suggest talking by telephone and either arrange a time or let your contact know you’ll be calling.  While you’ll still have to pick up the phone, you’ve created an expectation that you will call, and chances are good that you’ll avoid an awkward beginning.  If you suggest that you’ll call, though, you absolutely must do so – or run the risk of looking like a flake.
  • Send an article or other resource that will interest your contact. The resource may address a legal or non-legal issue, but it must be tied in some way to a conversation you’ve had with the contact.  Attach a note that says, “I remember talking with you about [topic of resource] at [wherever you had the conversation] and thought of you when I saw this [resource].  Hope it’s useful!”  By doing so, you not only reconnect by offering assistance, but you do so in a way that will bring your conversation back to your contact’s mind and refresh the relationship.
  • Issue an invitation. You might invite your contact to an open house or to attend a CLE or other seminar of interest with you.  Be sure to attach a note, if you deliver an invitation by mail or email, saying that you look forward to reconnecting; this personal touch will indicate to your contact that your interest is genuine.
  • Seek out news about your contact. This may be a more challenging approach if you’re seeking to reconnect than to maintain a relationship, but it’s worth a quick search to see whether your contact has been in the news recently.  You may find news of a professional event (an honor awarded, a trial won, a leadership position attained) or a personal event (a new marriage, a new baby, a recreational or community activity).  Such news offers an ideal reason to get in touch again.

Take a few minutes this week to review your list of contacts. With whom should you reconnect?  Choose three to five people and reach out to them.  Building and maintaining your network is always a valuable activity, and keeping relationships alive will often pay off (often in unexpected ways) over time.

Got resolutions?

The last couple of weeks of the year offers a fine time for several activities.  Finishing the last work of the year and getting bills out is task critical, but not the only one on the list.  Attending holiday gatherings and talking with clients and other contacts to express your appreciation and good wishes for the new year is likely at the top of the list.  (If it isn’t, perhaps you should reconsider.)  Recreation, relaxation, and re-energization may be on the list for many, which presents a good chance for starting 2009 ahead of the game.

I always recommend that, just as you close one day by checking on what went well or not and laying plans for the next day, you close the year in reflection and planning for the next year.  I recently challenged a client who’d been working some comfortable but unsuccessful client development activities with the observation that one definition of insanity is doing the same thing over and over and expecting different results.  After a moment’s silence, she chuckled wryly and said, “Well, I guess I’ve always been a little off….”
So, what’s gone well this year, and what must you change to reach your goals?  Sometimes the changes are minor, like choosing to reach out to a different group of lawyers in your firm or your network in hopes of building a stronger professional community.
And sometimes, the changes demand real courage and unflinching honesty.  When I started Life at the Bar in 2005, I faced a huge learning curve.  I wasn’t getting the results I wanted, so I decided to work harder… And harder… And then finally, exhausted, I looked squarely at the facts and admitted that I needed to change something if I really wanted different results.  That’s when I began re-examining my business approach and asked for help.  I worked with a marketing coach one-on-one for several months, and earlier this year I joined a marketing mastermind group led by a coach.
My results?  As of today, I’m reaching 294% more lawyers with this newsletter than I reached when it launched on January 13, 2008, and I’m no longer exhausted.  That change is terrific for my business, and (even more importantly) it means that I’m advancing my business purpose (of supporting lawyers in developing successful, satisfying, and sustainable practices, which in turn will help lawyers help their clients, which in turn has a huge impact on our society) more and faster than ever before.  And I’m laying plans for even more next year with the support and suggestions of my coach and the members of my mastermind group.
That’s my story.  What will your story be this year?  What will it be this time next year?  What’s working well, and what would you like to work better?  Where do you need to change?  What assistance do you need?  Spend a few minutes mulling this over.  Think big: what’s your ideal?  What do you need to do to get there?  And remember all aspects of your practice and life: your legal skills, your collegial relationships, your client service skills, your rainmaking activities and results, your career advancement, and so on.  Today’s book review will help tremendously with client service, which has an impact on business development as well.
An assignment: schedule an hour or so to reflect on this year and to lay your plans for next year.  The time will pay remarkable dividends.

Tips for making the host of holiday gatherings

Networking is always a popular topic for lawyers who are engaged in rainmaking, and the reason is simple: the people who know, like, and trust you will have an enormous influence on your success in practice.  And there’s no time like the holidays for networking, because so many organizations and groups arrange holiday gatherings.

If you’re an introvert and the very thought of attending a holiday gathering to develop business relationships makes you want to dive for the nearest rabbit hole, keep breathing.   Networking doesn’t have to be painful — not even for introverts.  How’s that?

Good networking involves relationship-building.  Most frequently, networking establishes the opening stages of a relationship that will mature over time.  Introverts can excel in establishing these relationships because so often, networkers are eager to talk about themselves, but introverts tend to be more comfortable asking questions and letting their conversation partner talk.  Introverts will distinguish themselves by focusing on the other person.  Ask questions like these:

  • What is most exciting in your business right now?
  • What concerns you most about what’s going on in your business or industry?
  • What do you want to see happening for you in 2009?

Asking questions and listening with genuine interest to the answers you get will benefit every networker in two ways: first, it takes the spotlight off the introvert, and second, you’ll have an opportunity to learn so much about the other person that you can connect him with beneficial resources, which he’ll appreciate.  Of course, you’ll need to say something about yourself as well (more on that in the next post) but you’ll find it much easier to talk about who you are and what you do after you’ve established rapport with a conversational partner.

A few additional thoughts on how to network well:

  • Be prepared with something to say. Know what the bignews story is, the key sports results, and have a thoughtful comment.
  • Be prepared to introduce yourself in 30 seconds, without stumbling. Use the template, I am [name], I do [kind of work] with [kind of client] so they can [get specific results].  Use clear words without jargon and invite curiosity.  If it’s boring to say, it’s boring to hear.
  • Carry business cards and have them easily accessible…..
  • ….But don’t offer indiscriminately them at the beginning of a conversation.  It’s far better to chat for a while, to know someone about the person, and then to ask for his or her business card. What if, horror of horrors, they don’t reciprocate and ask for yours? Not a problem. Send them one when you follow up after the event.
  • When someone offers you a business card, look at it before you put it away. A card is the tangible representation of the person with whom you’re speaking. Look at it, accord it due respect, and then carefully put it away.
  • Pay attention to the conversation. Don’t be one of these “power networkers” always looking over the shoulder of your conversational companion, looking for someone more interesting.
  • Listen. That deserves a separate bullet point. When your companion is talking, that’s your signal to listen to what they’re saying, not to be composing your witty rejoinder. It’s easier to be interested than interesting, and it’s also more attractive.
  • Think about how you can help the person with whom you’re talking. Make a contact, offer a lead, or just ask how you might recognize a terrific potential client/customer for her.
  • Set your intentions before you go (i.e., I will leave with 3 business cards of people I plan to contact again). Aim for quality over quantity.
  • Follow up with your contacts after the meeting.

To make the most of a networking event, you must follow up with the key people with whom you speak. Don’t overlook standard follow-up tactics like sharing a meal or coffee, a golf game, or a sporting or cultural event.  Think about other opportunities as well:

  • Follow up with some of the people you meet at a networking event with a handwritten note, tailored to the recipient. Then follow up on your follow-up with articles, resources, and the like, that are relevant to that person. Not so much that it’s obnoxious, but enough to make the person feel that you’ve really taken an interest in who they are and what they’re doing.
  • Reserve a table for 6 or 8 for lunch or dinner after your event (if it’s a cocktail party, for example) and invite several of the people you meet to join you.

The most important approach to making the most of the holiday gatherings you attend is to engage people.  Don’t hang around with the same people you see every day or every week: make it your goal to meet new people, to reconnect with those you no longer see regularly, and to set yourself up with some new business relationships to grow in the new year.

Survey says: increase intimacy, not fees.

It isn’t news to anyone that we’re in a tough and uncertain economy.  Nor is it news that business is slow.  The real question is, what can lawyers do today to weather this economy?  Summarized in yesterday’s AmLaw Daily, the answer is to develop client relationships.  The Advisory concluded that the substantial growth in law firm business over the last six years (growth that Hildebrandt called unprecedented) is due primarily to 6-8% annual fee increases.  So now what?  From the AmLaw Daily article:

Over the next 45 days, 10 percent of firms will announce rate increases, and 10 percent will announce no change. The other 80 percent will wait and see. Clients will aggressively push back on the increases, and many might be rolled back, either explicitly or via discounting. Those 80 percent who’ll be watching from the sidelines will take their cue from the no-changers, leaving those making increases adrift on a fast-melting ice floe. Even if they roll back, those increasing rates will have sent a clear message that they are out of touch with client reality in a way that will preclude any efforts to improve intimacy….

Seeking to improve client intimacy is both safer and easier than sticking to a diet of price increases. Until the last decade or two, any business school discussion of customer intimacy would have started with law firm business practices. Web 2.0 technologies make intimacy easier, but why not just start by inviting retired partners, especially the name partners who built the firm in the first place, to talk about how they did it ‘back in the day’? Reflecting on best practices, requiring every partner to talk to their top ten clients, sending senior management on the road to meet with clients and to discuss how to work together better is all pretty basic stuff.

In other words, talk with your clients.  Get to know them as individuals.  Go to their offices, ask what their concerns are, and offer to help where appropriate.  Building relationships doesn’t have to be difficult, and when approached authentically (in other words, not by faking sincerity), you will be on the road to becoming a trusted advisor.

Lawyers will often carry Phi-Beta Kappa keys, law review credentials, marquee college and law school degrees, and—after a few years of diligent and conscientious practice—a growing realization that they may be unemployable! How can this be? Throughout school your work has been “A” quality, tests confirm your abilities, you law work has proved impeccable—but advancement has been halted at a critical time in your career. Unlike the earlier part of your life, after six or seven years, law firms take for granted the quality of work and focus more on your ability to attract new business. The nitty-gritty that now counts has shifted, and how well you can sell yourself and your firm to new clients becomes paramount. Whether you like it or not, you’re at the level of Willy Loman in Death of a Salesman, not the intellectual equivalent to your college deans! This is a difficult fact to digest, and mystifies many lawyers while leading to an inconvenient-truth about modern law firm practice—it’s a business.

Unlike your school courses, where quality of work guaranteed success, being in a business environment is entirely foreign to the singular emphasis on good work that brought you there. Bringing in clients that pay their bills is now almost always a necessary (bordering on sufficient) metric by which you will be judged for promotions and bonuses. You can have other partners, of-counsels, associates or even contract attorneys do the actual work, just so long as you can bill on their backs.

“Don’t clients care about quality?” Of course they do, but there are a lot of smart lawyers (too many, some would say) and others can do just as well as you can and are waiting at the doors for the chance to show it. Julie Fleming-Brown has been flogging you with this realization for years, and it’s time you acted upon it. So, here are a few steps that can help you bridge the gulf between worker bee (read: potential victim) and rainmaker:

  • Start thinking of yourself as someone who needs to bring in business (change your mindset);
  • Look for opportunities to help potential clients, formulate a solutions-orientation strategy and communicate it to those people. Just make sure it’s intelligent and is designed so the prospect can understand it and see the value;
  • Tom Goldstein built a Supreme Court practice by finding split-decisions on Lexus-Nexus and asking the parties if they wanted to take their case to the Supreme Court, (a very simple, but entirely effective approach that led to his chairing his firm’s litigation and Supreme Court practice). Joel Popkin built a consulting practice by reading about corporate problems in the news, figuring out a potential solution, and writing a letter outlining the work and benefits to the CEO;
  • Tom Gorman puts many extra hours in per month for his website and blog, www.SECActions.com, where he keeps a large audience around the world up to-date on a variety of securities issues (and loves doing it!).

The above examples represent a small sample of what attorneys have done to build their client base for the good of both themselves and their firms. Surely, you can think of things that are even more effective, can’t you?

I recruit partners, of-counsels and some associates for the most prestigious law firms in the world, both here and overseas. Every day I hear from some hapless soul about how wonderful his or her work is and surely some firm needs their input. Sadly, they generally don’t. I do suggest that working on a marketing plan is the very best step any attorney can take to make themselves valuable, and I’m glad to help them in this effort. Even more than sketching out a plan is taking those first steps to implement the ideas.

Tuesday shorts 7/29/08 (happiness in the law, client relationships, Blackberry malaise)

I’m attending a conference this week, so I thought I’d load up a few links to good articles and blog posts some of you may not have seen.

Seven Simple Suggestions for Success and Happiness in the Law  The JD Bliss Blog recently posted a summary of a commencement speech by Stephen Ellis, a lawyer who has happily practiced for 36 years.  The suggestions are deceptively simple:

  • Be there for your clients when they need you.
  • Don’t be obnoxious.  Do a good job on the law, facts, and strategy, but don’t make it personal.
  • Be enthusiastic about your clients’ matters; ask how something can be done rather than rattling off reasons why it can’t.
  • Believe in your brain–some things people tell you really might not make sense.
  • Stay focused and stay with it–renew daily your commitment to good work and reliability daily.
  • Get “outside” yourself and participate in community events.  In addition to being a great way to meet more people and broaden your appreciation for your community, you have a lot to offer, and you’ll have fun.
  • Be nice.  In Ellis’ own words, “Cliche it may be, but being pleasant and friendly makes the day’s good spots better and the rough spots smoother. And that makes everyone’s life better–for sure yours.”

Well said!

Building strong client relationships  Frank D’Amore, founder of Attorney Career Catalysts (a legal recruiting, consulting, and training firm), published a helpful article in The Legal Intelligencer recently, discussing how a first-year partner who has landed a major client can build a solid, long-term relationship with the client.  (I particularly appreciated D’Amore’s reminder not to focus so heavily on any single client that business development efforts slow down or stop.)  To build a strong client relationship, D’Amore recommends:

  • Understand your client’s business and industry.
  • Keep your client fully in the loop about what’s happening in the matter.
  • Make your client look good at all times.
  • Maintain regular contact with your client, even when there’s a lull in the representation.
  • Consider how you might help key client contacts in ways that extend beyond legal services.

Stop blaming your Blackberry for your lack of self-discipline  Penelope Trunk, the Brazen Careerist, has a funny-because-it’s-true post about those whose lives are run by their Blackberries.  Yes, I understand needing to receive and respond to emails immediately sometimes, but anyone who’s ever complained about Blackberry bondage should read this post.  Just a clip (from the end of the post):

Blackberries are tools for the well-prioritized. If you feel like you’re being ruled by your Blackberry, you probably are. And the only way to free yourself from those shackles is to start prioritizing so that you know at any given moment what is the most important thing to do. Sometimes it will be the Blackberry, and sometimes it won’t. And the first step to doing this shift properly is recognizing that you can be on and off the Blackberry all day as a sign of empowerment.

Want to make more rain? Be a better leader.


Leaders are better rainmakers.
  Bold statement, isn’t it?  But think about it.  Would you easily place your trust in someone who manages a team of worker bees who don’t make much individual contribution – knowing that if the manager goes down, the team will at best miss a few beats?   Or would you select someone who is skilled in assembling a strong team and evoking high performance from its members?

 

Clients generally hire lawyers, not firms, but clients count on the lawyers to assemble and run the teams necessary to get the business accomplished.  A leader is more likely to walk into a meeting with a prospective client and present not only his or her own professional experience, but also that of the team, complete with discussion of how the team as a whole would function to meet the client’s needs.  There’s a difference between a team leader who counts on the skill and expertise of team members and a legal hotshot who regards the team as merely a supporting cast.  Clients and potential clients (not to mention the team) will sense that difference.

 

A leader is more likely to show up for a meeting with a client or prospective  client ready to ask questions.   Which is more impressive, someone who talks nonstop about the cases she’s won and the professional accolades she’s received, or someone who asks questions first to determine what’s needed and then offers how her skill and experience would serve to meet those needs?  Which behavior is more characteristic of a leader?

 

Leaders have the emotional intelligence to establish strong relationships, even when something goes wrong.  Unfortunately, despite our best efforts, legal matters don’t always go the way they “should.”  Juries are notoriously unpredictable, case law changes, and unforeseeable events happen that derail strategies, no matter how carefully planned or executed.  Leaders tend to have the integrity to take responsibility when appropriate, and they have the discernment to focus on how to make things as right as possible under the circumstances.  By handling problems in this way, leaders tend to become trusted advisors rather than hired guns.

 

What part of your leadership development path is calling for focus so you can also improve your client service and business development skills?  Perhaps it’s your presence, since the way you hold yourself and the way you communicate both verbally and non-verbally can have a dramatic impact on how you’re perceived.  Perhaps it’s your self-management in the areas of time or energy.  Or perhaps you could be a more effective team leader, whether your team is the whole firm, a practice area team, a client matter team, or a project team.  Make the time to improve your leadership skills, and you’ll see client benefits as well.
